I'm trying to help a friend out and it was recommended I come over here and seek information.

A lady that is a good friend of our family, husband died. Her husband has(had) a boat with a commercial salmon permit on it. She has the boat in her name, but when she tried to change the permit to her name, (until she decides what to do with it) the powers that be, told her she could not renew it, nor change the name on it, unless it specifically stated so in the will, which it does not. Is there anyway for her to be able to transfer it to her name or her sons name?

Any help would be very much appreciated. I feel it is almost like they are taking advantage of the situation and not treating her fairly.

Thanks.

Dave

I am no expert but I know it's hard to do anything even if you have a will (my experience). I should add that "a" will is nothing without the courts okay. So, it must first go to court (probate?) and the judge must sign off on it - will or not. They have to decide a lot of stuff about who truely owns what and who needs to be paid still etc, etc. and I don't think they piece meal it out one piece (permit) at a time. Of course, their time is money and they need to be paid - thats their story.

After it's all done she will get a court document listing all property and assets that she is now entitled to. Assuming the permit is on that list, she can then go to the CFEC and apply for a transfer.

So I guess my advice would be to get on it; this will take time. Yes, It all sucks.

Again, this is JMO.
