Leasing Power Troll Permits

After reading the info below, it's not clear to me how folks can legally lease someone else's permit and fish it except for emergency transfers. Can anyone clarify?

No. Permits cannot be leased simply because the permit holder does not want to fi sh. Leasing is prohibited by the

Limited Entry Act. However, if the permit holder has a legitimate reason for requesting an emergency transfer of the

permit, and a temporary transfer can be approved, the permit holder may receive payment for the use of the permit.

Why is it illegal to lease permits?

The legislature wanted permits to be held by active fi shermen and not individuals or entities that could exploit fi shermen.

The legislature made it illegal to lease permits to ensure that fi shermen could maintain control of their own

livelihoods and to ensure permits would be controlled by active fi shermen with a long-term stake in conservation of

fi shery resources. Allowing leasing could create a class of permit holders who would be absentee landlords of the

fi shery who could exploit the actual fi shermen forced to lease their permits.

Guess everyone is out fishing....grin.



Anyway, I have been wanting to lease a permit and have had several folks tell me it's easy to do. However, a quick 'net search revealed the info I posted above, and makes me leery of the whole idea.



Was hoping someone with some experience here would chime in. If not, I'll just wing it....

There is a short list of ways a permit may be leased, I can think of medical, govt service amd possibly school of the top of my head.

It sounds like you are on track. It is usually not a problem finding a permit to lease and the lease goes till the end of the year or whatever the leasee and the leasor agree.

Hi Rick,

Thanks for replying. I agree it's not tough to find permits available for lease, and I keep hearing about the 'ways' it can be done...but the info above is straight from the State's web page about it. I'm just reluctant to do the lease thing, in light of the info above.



Anyway, was just curious to hear folks' thoughts on the subject, and I appreciate you taking a moment to respond.

Hi Dave:



You can work with a permit holder to get an emergency transferred permit, but usually just for two years and under very specific circumstances: illness,death, disability, required military or government service, or other unavoidable hardship of a temporary,unexpected and unforeseen nature. School is not one of the reasons, nor is chronic illness, or just wanting to take some time off.



Leases of more than 2 years are unusual, because the owner would have to prove extraordinary circumstances to continue an emergency transfer, as opposed to just selling the permit.



Also, if someone is using a salmon permit on an emergency transfer and they get demerit points for a fishing violation, the permit holder will receive demerit points, too.



Your best bet prior to leasing a permit is to contact CFEC and talk to someone who can answer your specific questions:
